Unless you have a different license agreement obtained from AI Internet Solutions, installation or use of this software indicates your acceptance of the license and warranty limitation terms contained in this Agreement. If you do not agree to the terms of this Agreement, promptly delete and destroy all copies of the software and do not continue with this installation.
VERSIONS OF THIS SOFTWARE
There are three versions of CSE 3310 HTML Validator, each of which is subject to this agreement. UPON ORDERING, DOWNLOADING, INSTALLING OR USING ANY VERSION OF THE SOFTWARE, YOU ARE REAFFIRMING THAT YOU ARE BOUND TO THE TERMS OF THIS AGREEMENT.
The first version is the shareware version. The shareware version is the only version that is provided without charge; however, the shareware version is not free software. All rights and licenses to the shareware version automatically expire after the evaluation license period of 150 uses (validations), after which one must pay the appropriate licensing fee in order to continue using the software. If you choose not to obtain a license after the evaluation period, you must uninstall the software and discontinue any use until a license is obtained. The second version is a registered version for non-business use. This version may not be used for any purpose that is in the user's business interest. It may also not be used for government use. This version may only be used for personal or educational use.
The third version is a registered version for business and government use. This version may be used for any purpose, including business, government, personal, and educational use.
LICENSE TO USE
One copy of the shareware version of CSE 3310 HTML Validator may be used by a single person and on a single computer for evaluation purposes without charge for 150 validations. Reinstalling the same version, or a different version of CSE 3310 HTML Validator does not restart the evaluation license. The evaluation license may not be restarted for any reason.
One copy of the registered version of CSE 3310 HTML Validator may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used non-simultaneously by multiple people, but not both. You may access the registered version of CSE 3310 HTML Validator through a network, provided that you have obtained licenses for the software covering the maximum number of workstations that will access the software through the network simultaneously.
If you are a registered user, you are entitled to use this product for your own use. You may not sell, rent, or lease the software to others without the prior express, written permission of AI Internet Solutions.
You must not give away your registration code. Doing so will result in an infringement of copyright. AI Internet Solutions retains the right of claims for compensation in respect of damage which occured by your giving away the registration code. This claim shall also extent to all costs which AI Internet Solutions incurs in defending itself.
You may make a reasonable number of copies of any version of the software for backup and archival purposes.
LICENSE TO REDISTRIBUTE
You are licensed to make as many copies of the unmodified shareware version of this software and documentation as you wish, to give exact copies of the unmodified shareware version to anyone, and to distribute the shareware version of the software and documentation in its unmodified form via any means.
You are specifically prohibited from charging, or requesting donations, for any such distribution without the prior express, written permission of AI Internet Solutions.
NO ADDITIONAL LICENSES
All rights to the CSE 3310 HTML Validator software and documentation not expressly granted under this Agreement are reserved to AI Internet Solutions. You may not translate, decompile, disassemble or reverse engineer the software or documentation.
DISCLAIMER OF WARRANTY
This software is provided on an "AS IS" basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the software is borne by you. Should the software prove defective, you alone assume the entire cost of any service and repair.
SOME STATES DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO THIS DISCLAIMER MAY NOT APPLY TO YOU AND YOU MAY HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE OR BY JURISDICTION.
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL THE PRODUCER OF THIS SOFTWARE OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL THE PRODUCER OF THIS SOFTWARE BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE LIST PRICE FOR A LICENSE TO USE CSE 3310 HTML VALIDATOR, EVEN IF THE PRODUCER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE, SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.
GOVERNING LAW
This agreement shall be governed by the laws of the State of Texas.
